Alon Finkelstein's (missing) side of the story

This blog will be updating infrequently unless there is news on David Stodghill's release, additional charges filed against him, or if other items of key interest about him come to light.

Recent site updates included cleaning up and making adjustments to the Stodghill criminal timeline, and the addition of a "countdown clock" on the sidebar. The time til Stodghill's release from prison is based entirely on this blog's estimation.

One outstanding item that we don't want to let go is the extent Alon Finkelstein (pictured), aka Noah Fink, played in facilitating Stodghill's crimes.

David Stodghill determined to be a Sexually Violent Predator

Online court dockets were updated today to include the assessment by the Pennsylvania Sexual Offender Assessment Board determining that Stodghill is a "sexually violent predator."

Full text:
Upon consideration of the Commonwealth's praecipe pursuant to 42 Pa.C.S.A. Section 9795.4 (e), after a stipulation to the report of Dr. Stein, PhD., a member of the Pennsylvania Sexual Offender Assessment Board, the defendant is hereby determined to be a sexually violent predator.

David Stodghill Sentenced 4 to 8 Years; Must Register as Sex Offender for Life

According to online court documents (here and here), David Manning Stodghill was sentenced to four to eight years in prison for sexually assaulting two girls in 2009 and 1999. Due to the age of the girls and past criminal history of sexual assault, Stodghill has been designated for Lifetime Megans Law Registration.

Stodghill sentencing postponed until May

A hearing to determine if David Stodghill is to be designated a sexually violent predator (SVP) has been postponed until May 11th. Stodghill's sentencing date has also been postponed, and is now scheduled for May 17th.

The SVP/Megans Law hearing, originally scheduled for today, needs to be held prior to sentencing. Court dockets show that on Friday lawyers for Stodghill requested a continuance for the hearing.

Stodghill's sentencing will be for sexually assaulting a 13 year old girl in 1999, and a 12 year old girl in 2009. He previously served 5 months in prison for sexually assaulting a 12 year old girl in 1995. Additionally, in 1991 Stodghill was convicted for "concealing the whereabouts of a child." In each case Stodghill pled guilty.

Stodghill's Sentencing Date Postponed Due to Megans Law Hearing

David Stodghill's sentencing date, originally scheduled for February 8th, has been postponed until March 29th. According to court dockets, this was postponed after "a hearing to determine if the defendant is a sexually violent predator" was scheduled for March 23rd.

Stodghill's Sentencing and Sex Offender Registry Requirements Pending

David Stodghill's sentencing is still scheduled for February 8th when, per his plea deal, he will face between 4 and 8 years in prison. In addition, at some point it will also be decided if he should be included on Megan's Law Registry for the State of Pennsylvania.

While there is little doubt Stodghill will be required to register as a sex offender, it is unclear if this will be for the 10 year or lifetime registration period.

Among the convictions that would require someone to register for ten years is indecent assault "where the offense is graded as a misdemeanor of the first degree or higher." Lifetime registration would require two or more of such offenses.

Of Stodghill's recent guilty pleas, only one qualifies: his June, 2009 conviction for "aggravated sexual assault" of a 12 year old girl. His guilty plea for sexually assaulting a 13 year old girl in 1999 is considered a second degree misdemeanor.

His first known conviction of sexual assault, of an eleven year old Carlisle girl in 1995, also ended with a guilty plea. Due to the girl's age, this appears to be considered a first degree misdemeanor. Regardless, it is uncertain if a sexual assault committed in August 1995 would apply to the current Megans Law assessment as Megans Laws wasn't enacted in Pennsylania until April 1996.

There are other conditions surrounding Megans Law that I may have overlooked, and it is also possible that additional charges could be forthcoming against Stodghill that could make him eligible for lifetime Megans Law registration requirements, but his lifelong history of sexual assault against minors alone makes a four to eight year prison sentence and ten year notification period seem very short.

To summarize Stodghill's history of sexual assault convictions:
  • August 1995: Stodghill, aged 22, sexually assaults an 11 year old girl in Carlisle, PA, and receives 5  to 23 months as part of a guilty plea (a charge of aggravated indecent assault is dismissed). The following April, he is paroled after serving 5 months in prison.
  • March 1999: Stodghill, 26, sexually assaults a 13 year old girl in Hampden, PA. Before police can question him, he flees with his wife and two year old daughter to Ocean City, Maryland. Five months later he is arrested and extradited. According to sources, the victim is too frightened of Stodghill to testify and charges are initially dropped, then renewed eleven years later in 2010.
  • June 2009: Stodghill, 37, sexually assaults a 12 year old girl in Shippensburg, PA. He flees to Los Angeles, California, where Federal Marshalls and Immigration and Customs agents track him down and arrest him seven months later. Sentencing for this and the 1999 assault are pending.
