Stodghill Pleads Guilty To Child Molestation Cases

David Stodghill has pled guilty in two child molestation cases.

According to court records, in the 1999 case Stodghill pled guilty to Indecent Assault With A Person Less Than 16 Years Old, a misdemeanor, but a felony charge of Aggravated Indecent Assault was dismissed. In the more recent, 2009 case, Stodghill pled guilty to Aggravated Indecent Assault with a Complainant Less Than 13 Years Old, while a misdemeanor Indecent Assault charge was dismissed.

A statement given to police by a woman Stodghill married after he fled to Los Angeles last year may have been the tipping point.

According to Penn Live, Stodghill had "told his new wife about the incidents, including showing her an illicit photo of the most recent victim and pornographic videos of other children, according to court documents. Stodghill had not divorced his first wife when he remarried, so prosecutors could use statements from his second wife against him..."

Penn Live, which broke today's news, adds that Stodghill is scheduled to be sentenced on February 8th, and could get four to eight years in state prison.

Court date set for Stodghill's earlier alleged victim.

A January 24, 2011 trial has been set for Stodghill to face accusations including aggravated indecent assault against a minor that allegedly took place over eleven years ago.

The date of his November 15th trial to face charges for aggravated indecent assault against another minor in a June, 1999 incident appears to still be scheduled according to previously linked court dockets.

Stodghill court date postponed. Again.

The trial date for David Stodghill stemming from the alleged child sexual abuse in June, 2009 has been moved to November 15th.

Stodghill's  formal arraignment stemming from an alleged instance of child sex abuse on March 28, 1999 is still scheduled for October 21st.

Another indecent sexual assault charge filed against David Stodghill

Another victim has come forward alleging to have been molested by David Stodghill from an incident that occurred in 1999. According to online documents, a preliminary hearing for Stodghill was held on August 18th to face charges of Corruption of Minors, Indecent Assault, and Aggravated Indecent Assault with a complainant less than 16 years old.

An anonymous source has told me that in 1999, Stodghill molested the victim, a 13 year old girl. She pressed charges, and when Stodghill learned of this quickly moved him and his family to Ocean City, Maryland, where they lived for 5 months until he was arrested and extradicted back to Cumberland County, PA to face trial. The young victim was too afraid to testify, and the charges were dropped. However, when she heard of the current charges facing Stodghill, she decided to refile the charges, which will now be heard in court.

A voice mail left with the Hampden Township Police officer handling this case, to confirm these details, was not returned by the time of this posting.

Stodghill's court date postponed til September 27th

Per online documents, Stodghill has request a continuance of his trial, previously scheduled for August 9th. A pre-trial conference is scheduled for September 16th.

No reason is listed for the postponement.

August trial date set for David Stodghill

"The Commonwealth of Pennsylvania vs. David Stodghill" has an August 8th court date set, per online documents updated this week following Stodghill's formal arraignment.

The same documents also list the "Commonwealth's notice of mandatory sentence" with regard to the charge of Aggravated Indecent Assault (With A Complainant Less Than 13 Years Old). The minimum sentence for this charge is 5 years.

There is no indication if Stodghill is requesting a trial by jury or charge.

The two additional charges associated with this complaint (Indecent Assault and Corruption of Minors) are also set to go to trial on the same day along with separate charges of Marijuana and Drug Paraphernalia Possession and Harassment.

David Stodghill's alleged long history with child porn

While most people who read this blog are aware that the current charges David Stodghill faces are nothing new to him - in 1995 he was convicted of sexually assaulting a minor, and in 1991 of concealing the whereabout of a minor - this blog has also confirmed that in 2001 Federal authorities were investigating Stodghill for creating and distributing child porn.

According to the warrant that led to his arrest earlier this year, in February 2001 the Lee County, FL Sheriff's office received an anonymous tip that David Stodghill was taking photos of his minor children and posting them at Per the warrant, "Included in the letter were several pictures of children involved in sexual acts."

Federal customs officials and local law enforcement attempted to contact Stodghill, who lived in the Fort Myers, FL area at the time, for an interview, but soon discovered that he and his family had abruptly fled. Law enforcement were also informed that the Department of Family Services had attempted to do a well-being check on Stodghill and his children in the months prior.

The warrant goes on to refer to Stodghill's 2009 and 2010 Los Angeles activities as his "Continued Child Pornography Possession in California," and that his current wife "had seen a manila folder in the residence which contained printouts of children engaged in sexual acts."

Tomorrow morning (Thursday, June 10th) Stodghill will face formal arraignment for charges of sexual assault of a minor under the age of 13. While there are no charges of child pornography at this time, the search warrant also alleges that Stodghill took naked photos of his female accuser.

Stodghill's formal arraignment June 10th; could he be released on parole before then?

Criminal dockets posted online list June 10th as the start of David Stodghill's preliminary arraignment for all charges currently pending against him, including aggravated sexual assaults against a minor under the age of 13, harassment, and drug possession.

Of concern is also an application for an "ARD Hearing" on the dockets regarding the child sex offense charges. If granted for an "Accelerated Rehabilitative Disposition," Stodghill could be released from prison immediately even without a guilty plea and placed on parole with certain conditions. After the parole terms have been met, Stodghill could then seek to have the charges expunged from his record.

The dockets also list another alias used by Stodghill: David M. Aten.

Details from David Stodghill's preliminary hearing

Stodghill's 13 year old accuser testifies, and info about ICE agents needing to stop a bus at gunpoint to make his arrest, among the details from an article in yesterday's Shippensburg Sentinel:
The girl testified at the hearing Monday, prompting Stodghill to look down at his hands several times and shake his head from side to side as she spoke.

She testified that Stodghill “often” did “all kind of weird stuff” to her, including describing oral sex to her and asking her to perform acts. She said she sometimes awoke with “sore” genitals after spending the night at Stodghill’s residence. She said the behavior persisted for about three years, until she “finally got tired of it” and told her mother.
Stodghill also claimed that he did not flee Shippensburg, but simply left for California to take photographs of the Michael Jackson funeral.

Assistant Cumberland County District Attorney Jaime Keating responded by offering details of Stodghill's lengths to elude Federal Marshalls and ICE agents last month in Los Angeles:
Keating said Stodghill changed his appearance while in California and fled his Cahuenga Boulevard condo just prior to the arrival of the ICE agents...

Keating said the agents “treed” Stodghill three days after his initial escape, only to see him jump from the tree, scramble to his feet and flee quickly enough to get aboard a public transportation bus.

He was captured only after agents stopped the bus at gunpoint, Keating said.
While Stodghill's public defender attempted to have a reduction in his $25,000 bail for these charges, after hearing the evidence the judge raised it to $150,000.

Stodghill's bail skyrockets to $150,000 after preliminary hearing

Following this morning's preliminary hearing, bail for David Stodghill on the charges of aggravated indecent assault, indecent assault, and corruption of minors have skyrocketed to $150,000, and he continues to be held at Cumberland County Prison.

Not many details to add than what is available on the court dockets , but it is presumed that the bail was increased after the judge was able to review the full weight of the charges and Stodghill's previous outstanding warrants and fugitive status from the same court system.

Stodghill's bail doubled to $50,000

After being arraigned on earlier charges, Stodghill's $25,000 bail for his alleged sexual abuse of a minor was effectively raised to $50,000 at an arraigment on March 1st, per documents posted on the Pennsylvania Courts website.

For a harrassment charge originally filed July 6th, bail was set at $10,000. For charges of marijuana and drug paraphernalia originally filed on June 30th, bail was set for $15,000. Stodghill failed to appear to original court summons for these charges over the summer, after he'd reportedly fled to the Los Angeles area.

Currently being held at Cumberland County Prison, these same documents list March 22nd as a release date, the same day as his preliminary hearing. It is presumed that District Attorney David Freed will ask Stodghill to be detained through further court proceedings due to the weight of the charges and Stodghill's former fugitive status.

Bail set for David Stodghill: $25,000 (UPDATED)

According to documents posted online by the Pennsylvania court system, bail for David Stodghill has been set at $25,000 for charges of aggravated indecent assault, indecent assault, and corruption of minors. This amount appears to be extremely low considering Stodghill's previous fugitive status and parole violations.

A preliminary is listed as beginning Thursday, March 4th.

Update: In an article about Stodghill's return to Cumberland County Prison, writes that law enforcement was working to increase his bail amount:

District Attorney David Freed says the nature of Stodghill’s alleged crimes and “the fact that we had to go to California to get him” are a concern. Freed points out that the amount of bail is the sole discretion of Brewbaker at this point, but there are alternatives available.

“We are concerned about this defendant,” Freed said. “We do not believe that the MDJ had the full story in front of her when she made the bail decision. We are working with the state police to gather the pertinent information and intend to file a motion to have the bail decision reconsidered.”


Sgt. Jonathan Mays of state police at Carlisle said other arrest warrants for Stodghill’s arrest on lesser charges are being processed.

“If he made bail right now, these warrants would pop up to hold him for a short time,” Mays said. “That gives us a little time.”

A preliminary hearing for Stodghill was set for Thursday but will have to be rescheduled because Magisterial District Judge Harold Bender, in Shippensburg where the charges were filed, is out of town.

David Stodghill on a road trip to Cumberlink County

Cumberlink reports that David Stodghill's transport from a prison in Los Angeles to Pennsylania may be a long one, without even an estimated time of arrival, as he's being delivered via Prisoner Transport Services, per Cumberland County District Attorney David Freed:

He says the length of the trip is dependent on how many other prisoners must be picked up along the way and where those pickups happen.

The contract extradition service is the most cost effective method for the county to employ, Freed says.

Stodghill waives extradition hearing

Dale Heberlig, who has been covering the David Stodghill story for the Sentinel/ since June, reports that on Friday Stodghill waived his right to an extradition hearing.
Cumberland County District Attorney David Freed says Stodghill must be picked up by Feb. 22 for his return to Pennsylvania.
The LASD Inmate search shows that Stodghill is now being held at the North County Correctional Facility, a maximum security prison located in the north Los Angeles County community of Castaic.

More details on David Stodghill's arrest and life in Los Angeles

Friday's Sentinel Online provides a few amazing new details about David Stodghill's arrest and life in Los Angeles, including a weekend camping out, and a second marriage:
  • Following last Friday night's botched raid, Stodghill spent the weekend hiding out in a Pasadena park. (which is where police were tipped they would find him, which led to a foot chase and arrest sometime Monday or early Tuesday).
  • Stodghill married a woman from Pennsylvania in the Los Angeles area September 2009 - this is while he was separated, but not divorced, from his current wife Samantha Burd Stodghill.
No word yet if Stodghill will be charged with bigamy, which carries the following punishment in California:
Bigamy is punishable by a fine not exceeding ten thousand
dollars ($10,000) or by imprisonment in a county jail not exceeding
one year or in the state prison. (from here)
In Pennsylvania, bigamy is a Class 2 Misdemeanor.

The Los Angeles County Prison website lists Stodghill's next court appearance for February 24th at 8:30am.

"Fugitive" David Stodghill in custody in Los Angeles


David Stodghill was captured in the Los Angeles area Monday night, the Shippensburg Sentinel is reporting. (*UPDATE: the Bureau of Immigration and Customs Enforcement is listed on an LA County Sherriff's Department website as the arresting agency.)

The charges (from yesterday's Shippensburg Sentinel):
Sgt. Jonathan Mays of state police at Carlisle said the warrant was the response to criminal charges filed earlier in the day before Magisterial District Judge Harold Bender in Shippensburg. He is charged with indecent assault, aggravated indecent assault and corruption of minors.

According to the criminal complaint, Stodghill violated the 12-year-old at his room in a Shippensburg rooming house in June 2009.

According to the complaint, the girl told police and child authorities that Stodghill took her clothing and towel while she showered, then photographed her nude when she left the bathroom to retrieve her belongs.

Afterward, she told police Stodghill engaged in illegal physical contact with her.

On Friday night, Stodghill "was not located when Los Angeles police, Immigration and Customs Enforcement (ICE) agents and federal marshals descended on a Caheunga Boulevard residence in the city."

UPDATE: The Los Angeles County Sherriff's Department website lists David Stodghill as being currently incarcerated at the Inmate Reception Center at the Twin Towers Correctional Facility in downtown Los Angeles. Below are some details from time of posting.

David Stodghill charged with sexually assaulting a child

According to a criminal docket dated January 29th, 2010, David Manning Stodghill was charged with the following acts in Shippensburg, PA:

Aggravated Indecent Assault with a person under the age of 13, Indecent Assault with a person under the age of 13, and Corruption of Minors.

If convicted or he pleads guilty to either indecent assault charge, Stodghill would need to also register as a sex offender. (there is debate as to if Stodghill should already need to be registered as a sex offender based on previous convictions). The Aggravated Indecent Assault Charge would carry a five year minimum sentence.

I wanted to once more offer you the chance to explain your business association with David Stodghill and where it stands now. Anyone who Googles your name or aliases will probably come across this blog and the post on the Photo Business & News Forum.

If you are still willingly associating with Stodghill, then ignore this, but I believe that by now you have learned you need to be far away from him.

One more thing: A friend of Stodghill's emailed me to say the reason he believed David had died was because of a message left on Stodghill's Facebook page on November 3rd that said "RIP DMS," left by Alon. Again, I have long believed Stodghill hijacked Alon's Facebook, and a few people close to the Stodghill family have since told me that David is not dead.
